OVERVIEW
Terms of Service – Tiny Candle Shoppe
Welcome to Tiny Candle Shoppe ("we", "us", "our"). By visiting our website and/or purchasing products from us, you engage in our "Service" and agree to be bound by the following terms and conditions.
Please read these Terms of Service carefully before accessing or making a purchase from our website.
1. Overview
Business Name: Tiny Candle Shoppe
Location: United Kingdom
Applicability: These terms apply to all online retail sales of goods (such as candles, home fragrance, and giftware) made to consumers based in the UK.
By placing an order on our site, you confirm that you are at least 18 years old and legally capable of entering into binding contracts.
2. Orders and Contract Formation
When you place an order through our website, you are offering to purchase goods under these Terms.
We will send you an order acknowledgement email; however, the legal contract is only formed when we dispatch your goods and send you a dispatch confirmation email.
We reserve the right to refuse or cancel any order prior to dispatch due to stock unavailability, pricing errors, or failure of payment authorization.
3. Price and Payment
All prices shown on our website are in British Pounds (£) and are inclusive of VAT (where applicable) at the current UK rate, but exclude delivery charges unless explicitly stated.
Delivery costs will be clearly displayed at checkout before you submit your payment.
We accept payment via major credit/debit cards and approved online payment gateways. Your card will be charged upon checkout.
4. Delivery
We will deliver the goods to the address provided by you during the checkout process.
Unless otherwise agreed, we aim to dispatch goods promptly and will deliver them within 30 days of the contract date.
Risk of damage to or loss of the goods passes to you upon physical delivery.
5. Right to Cancel and Cooling-Off Period (UK Consumer Contracts Regulations)
Under UK distance selling laws, if you are contracting as a consumer, you have statutory rights to change your mind:
Cancellation Period: You have the right to cancel your contract up to 14 days after the day you (or someone nominated by you) receive the goods, without giving any reason.
How to Cancel: To exercise your right to cancel, you must inform us of your decision by a clear statement (e.g., via email to our support address). You may use the model cancellation form at the bottom of these terms, though it is not mandatory.
Returning Goods: If you cancel, you must return the goods to us at your own expense without undue delay and no later than 14 days from the day you notify us of cancellation. Goods must be unused, in their original packaging, and in a resalable condition.
Return Shipping Costs: Unless the item is faulty or misdescribed, you are responsible for the direct cost of returning the items.
6. Refunds
If you cancel your contract within the 14-day cooling-off period, we will issue a full refund of the price paid for the goods, including the basic cost of delivery originally paid.
We may make a deduction from the refund for any loss in value of the goods supplied if the loss is the result of unnecessary handling by you.
Refunds will be processed within 14 days of us receiving the returned goods back, or proof of postage from you—whichever is sooner.
7. Faulty, Damaged, or Misdescribed Goods
Under the Consumer Rights Act 2015, goods supplied must be of satisfactory quality, fit for purpose, and as described.
If your candle or giftware item arrives damaged or faulty, please contact us within a reasonable timeframe. We will arrange for a replacement or a full refund including return postage costs.
8. Limitation of Liability
We only supply products for domestic and private use. We accept no liability to you for any loss of profit, business, interruption, or business opportunity.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be legally excluded under UK law.
9. Governing Law
These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of England and Wales, and the courts of the UK shall have exclusive jurisdiction.
